The new Canary Islands law on holiday homes: what the text says

Since 13 December 2025, Canary Islands Law 6/2025 has changed the rules for anyone renting a home to tourists. In 2026, Law 7/2026 already amended it. Here we summarise what the published text says, with sources, for anyone who owns or wants to buy a home in Fuerteventura.
Tourist use depends on the municipal plan
The law does not allow tourist letting in any home. A residential home can be used for tourist accommodation only if the municipal plan expressly allows it. Protected natural areas, the Natura 2000 network, protected rural land and flood zones are excluded.
The residential reserve
Article 4 sets a minimum reserve: at least 90% of the buildable area or of the number of homes stays in exclusive residential use. The threshold drops to 80% only in La Palma, La Gomera, El Hierro and municipalities facing depopulation. Fuerteventura is not on the 80% list.
If you already have a vivienda vacacional
Homes registered under Decree 113/2015 have a five-year transitional regime. The owner can apply to consolidate the tourist use: the right is personal and ends when the property changes hands.
